These Terms and Conditions apply to services provided by Bendigo Acupuncture & Chinese Medicine (“we”, “us” or “the Clinic”). By booking an appointment, you agree to these Terms.
We provide acupuncture, Chinese medicine consultations, herbal medicine and related wellness services. These services are intended to support your health and wellbeing and are not a substitute for emergency care, diagnosis or treatment by a medical practitioner.
Results vary between individuals. We do not guarantee a particular outcome.
You must not delay, stop or change prescribed medical treatment based solely on information provided by the Clinic.
You must provide complete and accurate information about your health, including:
• current medications, supplements and herbal products;
• allergies or previous reactions;
• pregnancy or suspected pregnancy;
• bleeding disorders or use of blood-thinning medication;
• relevant medical conditions, surgeries and treatments; and
• any significant change in your health.
You must tell us if your health changes before treatment. We may postpone or decline treatment where we reasonably believe it is unsafe or unsuitable.
Before treatment, we will explain the proposed service, expected benefits, material risks and available alternatives where reasonably applicable. You may ask questions or withdraw consent at any time.
Acupuncture is generally considered safe when performed appropriately, but possible risks include temporary pain, bruising, bleeding, dizziness, fainting, nausea, fatigue, skin irritation, infection and, rarely, more serious injury.
You must immediately tell the practitioner if you feel unwell during treatment. If you experience severe or concerning symptoms after treatment, seek urgent medical attention or contact emergency services.
Herbal products may cause side effects, allergic reactions or interactions with medicines, supplements or other treatments. We may recommend that you consult your doctor or pharmacist before using herbs.
You agree to:
• follow dosage and storage instructions;
• use only the products supplied or approved by the Clinic;
• not share prescribed or dispensed herbs with another person;
• tell us about any adverse reaction; and
• stop using the product and seek medical advice if you experience a concerning reaction.
The Clinic is not responsible for harm caused by undisclosed medical information, misuse, incorrect dosage, use contrary to instructions or combining products without professional advice.
Appointments are subject to availability. Please arrive on time. Late arrival of 15 minutes will incur a cancellation, and the full cancellation fee will apply.
We may reschedule an appointment where necessary due to practitioner illness, safety concerns, operational requirements or circumstances outside our reasonable control.
We require at least 24 hours’ notice to cancel or reschedule an appointment.
A $90 cancellation or rescheduling fee will apply where:
• an appointment is cancelled or rescheduled less than 24 hours before the appointment;
• you do not attend your appointment; or
• you arrive too late for the appointment to proceed.
The fee may be charged to the payment method held on file or invoiced to you. The fee will not apply where the Clinic agrees that exceptional circumstances justify waiving it.
Where a non-refundable booking fee has already been paid for that appointment, it is applied toward the cancellation fee rather than charged in addition to it.
Nothing in this clause limits any rights you may have under applicable consumer law.
Fees are displayed at the time of booking or are available from the Clinic. Payment is due at the time of treatment unless otherwise agreed.
Additional products, consultations or services will be charged separately where applicable. We may refuse future bookings where an account remains unpaid.
All consultations require a non-refundable booking fee of $60, payable at the time of booking. This fee is deducted from the total fee for that consultation. Where an appointment is cancelled or rescheduled with less than 24 hours’ notice, is not attended, or you arrive too late for it to proceed, the booking fee is retained and applied toward the cancellation fee set out in clause 6, so that the total amount payable does not exceed that cancellation fee.
Reviews must be genuine and must not knowingly contain false statements, threats, harassment, confidential health information, discriminatory material or personal information about staff or other patients.
We may respond to feedback, request removal of content that breaches a review platform’s rules or take action regarding unlawful, threatening, defamatory or knowingly false content. Nothing in these Terms prevents you from making a genuine complaint to a regulator, health complaints body or other lawful authority.
Patients and visitors must behave respectfully toward staff and other patients. We may end an appointment or refuse future bookings where there is violence, threats, harassment, discrimination, intoxication, abusive conduct or conduct that creates a safety risk.
We collect, use and store personal and health information in accordance with applicable privacy laws, including the Privacy Act 1988 (Cth) and the Health Records Act 2001 (Vic).
We will not disclose your health information except with your consent, where required or authorised by law, or where necessary to protect safety.
A parent, guardian or authorised support person may be required to provide consent for a person under 18 or a person who cannot provide legally effective consent.
The Clinic is not an emergency service. Call 000 or attend the nearest emergency department for urgent or life-threatening symptoms.
To the extent permitted by law, the Clinic is not responsible for loss, injury or damage resulting from failure to disclose relevant health information, failure to follow treatment or product instructions, or misuse of herbal products.
Nothing in these Terms excludes, restricts or modifies any consumer guarantee, liability or right that cannot lawfully be excluded, restricted or modified.
If you have a concern, please contact us at info@team-clinic.com or on 5442 5551. We will aim to acknowledge your complaint within 5 business days and investigate it fairly.
We may update these Terms from time to time. The current version will be published on this website. Changes will apply to future bookings and services unless otherwise required by law.
These Terms are governed by the laws of Victoria, Australia. Any dispute will be subject to the courts of that jurisdiction, unless applicable law provides otherwise.
